Terms of Service

By accessing or using ShopPal services, you agree to be bound by these Terms of Service and our Privacy Policy. If you disagree with any part, you may not use our services.

Account Registration

• You must be at least 13 years old to use ShopPal
• You must provide accurate, current information
• You are responsible for maintaining account security
• One person, one account (no duplicate accounts)
• You are liable for all activities under your account

Account Termination

We reserve the right to suspend or terminate accounts that violate these terms, engage in fraudulent activity, or misuse the platform.

You Agree To:

• Provide accurate product information (shop owners)
• Honor orders and commitments made on the platform
• Communicate respectfully with other users
• Comply with all applicable laws and regulations
• Report suspicious or fraudulent activity

You Must NOT:

• Post illegal, harmful, or offensive content
• Engage in fraud, scams, or deceptive practices
• Harass, threaten, or abuse other users
• Spam or send unsolicited messages
• Attempt to hack, breach security, or reverse engineer
• Sell prohibited items (weapons, drugs, counterfeit goods)
• Impersonate others or create fake accounts

Product Listings

• You must own or have rights to sell listed products
• Product descriptions must be accurate and truthful
• Images must represent the actual product
• Pricing must be clear and not misleading

Order Fulfillment

• Process orders within 24 hours
• Deliver products as described and on time
• Handle returns and refunds professionally
• Maintain good customer service standards

Commissions & Fees

ShopPal charges a commission on completed sales. Current rates are available in your seller dashboard. Payment processing fees may also apply.

Driver Requirements

• Valid driver's license and vehicle registration
• Vehicle insurance and roadworthy certificate
• Clean driving record
• Professional conduct at all times

Service Standards

• Accept trips within reasonable distance
• Maintain vehicle cleanliness and safety
• Follow traffic laws and regulations
• Respect customer property and privacy

Payment Terms

Driver earnings are paid weekly via EcoCash or bank transfer. Platform fees and commissions apply as outlined in your driver agreement.

WhatsApp-Specific Rules

• Bot is for legitimate shopping and support purposes only
• Do not spam or abuse the chatbot service
• Messages are logged for quality and support
• You can opt-out by sending "STOP" or blocking the number

Prohibited on WhatsApp Bot:

• Harassment or abusive language
• Sending illegal content or links
• Attempting to hack or exploit the bot
• Using the bot for commercial spam

WhatsApp Compliance: We comply with WhatsApp's Business Policy and Commerce Policy.

App Usage

• App is provided "as is" without warranties
• We may update, modify, or discontinue features
• You must keep the app updated for security
• Unauthorized modifications (rooting/jailbreaking) may result in account suspension

License

We grant you a limited, non-exclusive, non-transferable license to use the ShopPal app for personal, non-commercial purposes. You may not resell, distribute, or reverse engineer the app.

Payment Processing

• We support EcoCash, bank transfers, and other methods
• All payments are processed securely
• You authorize charges for purchases made
• Prices are in USD unless otherwise stated

Refund Policy

• Refunds depend on shop owner policies
• Disputes should be raised within 7 days
• We mediate disputes but are not liable for seller actions
• Platform fees are non-refundable

All content on ShopPal (logo, design, code, text) is owned by bkAfrica or licensed to us. You may not copy, reproduce, or distribute our content without permission.

User Content: You retain ownership of content you post but grant ShopPal a license to use, display, and distribute it on our platform.

ShopPal acts as a marketplace platform. We are not responsible for:

• Quality, safety, or legality of products sold
• Accuracy of shop owner or driver information
• Disputes between buyers and sellers
• Lost data, service interruptions, or technical issues

Maximum Liability: Our total liability is limited to the amount you paid to ShopPal in the past 12 months, or $100, whichever is less.

You agree to indemnify and hold ShopPal harmless from any claims, damages, or expenses arising from your use of the platform, violation of these terms, or infringement of third-party rights.

We may update these terms at any time. Significant changes will be communicated via email or in-app notification. Continued use of ShopPal after changes constitutes acceptance.

These terms are governed by the laws of Zimbabwe. Disputes will be resolved in courts of Harare, Zimbabwe.
